The Combustion Engineering 524(g) Asbestos PI Trust (the Trust), organized pursuant to the laws of the State of Delaware was established pursuant to the Combustion Engineering, Inc.’s (CE) plan of reorganization, as modified through October 7, 2005 (the Plan). The Trust was formed to assume all Asbestos PI Trust claims (whether now existing or arising at any time hereafter) and to use the Asbestos PI Trust assets to pay holders of claims in accordance with the Asbestos PI Trust agreement. The Trust’s funding is dedicated solely to the settlement of asbestos health claims and the related costs thereto, as defined in the Plan.
